THIS PRENUPTIAL AGREEMENT is made this __ day of ___, 20__.
BY AND BETWEEN:
Mr. ______________________________________, a ___________ national, holding a __________ passport with No______ having his permanent address at ___________ ____________, hereinafter referred to as the “Prospective Husband” of the one part, copy of passport is attached hereto as Exhibit A.
AND
Ms. _______________________________________, a Thai national holding a Thai ID-card with No._____, residing at ____________ , hereinafter referred to as the “Prospective Wife” of the other part, copy of ID Card and household registration booklet are attached hereto as Exhibit B.
WHEREAS
Prospective Husband and Prospective Wife contemplate marriage in the near future under the law of Kingdom of Thailand and wish to establish their respective rights and responsibilities regarding each other’s management of the properties during the marriage.
Prospective Husband and Prospective Wife have made a full and complete disclosure to each other of all of their financial assets and liabilities, as more fully set forth in the accompanying Financial Statements, attached hereto as Exhibits C and D.
Prospective Husband and Prospective Wife hereby mutually agree that the management of the personal property and the common property shall be governed by this Prenuptial Agreement.
NOW AND THEREFORE THE PARTIES HEREBY AGREE AS FOLLOWS:
PERSONAL PROPERTY (SIN SUAN TUA)
Personal Property of the Prospective Husband consists of:
- Property belonging to Prospective Husband before marriage;
- Property for personal use, dress or ornament suitable for station in life, or tools necessary for carrying on the profession of the Prospective Husband;
- Property acquired by Prospective Husband during marriage through a will or gift;
- As regards item (1) to item (3) mentioned above, any increase in value of it or if it has been exchanged to other property or income derived from it, other property has been bought or money has been acquired from selling, such other property or money acquired shall be personal property of Prospective Husband;
- Where item (1) to item (4) mentioned above has been totally or partly destroyed but replaced by other property or money, such other property or money shall be personal property of Prospective Husband; and
- Property as listed in Exhibits C.
Personal Property of the Prospective Wife consists of:
- Property belonging to Prospective Wife before marriage;
- Property for personal use, dress or ornament suitable for station in life, or tools necessary for carrying on the profession of the Prospective Wife;
- Property acquired by Prospective Wife during marriage through a will or gift;
- Property given by Prospective Husband to Prospective Wife in betrothal, if any;
- As regards item (1) to item (3) mentioned above, any increase in value or if it has been exchanged to other property or income derived from it, other property has been bought or money has been acquired from selling, such other property or money acquired shall be personal property of Prospective Wife;
- Where item (1) to item (5) mentioned above has been totally or partly destroyed but replaced by other property or money, such other property or money shall be personal property of Prospective Wife; and
- Property as listed in Exhibits D.2.;
COMMON PROPERTY (SIN SOMROS) สินสมรส
(1) Subject to Clause 1, Common Property shall be consisted of:
a) Property to be acquired jointly by the Prospective Husband and the Prospective Wife during marriage;
b) Property to be acquired by either Prospective Husband or Prospective Wife during marriage through a will or gift made in writing if it is declared by such will or deed of gift to be common property; and
